This reminds me of a funny story I read on /. not to long ago, about your general debate on automatically accepting EULA's when you open a piece of software or a game, or click Accept/Ok for that software once installed.

Anyways, it steered towards "what if your cat accidentally walked across the keyboard, while you were AFK, and hit Enter for it to click Accept/OK? Or your cat decided to do some non-furniture shredding, on that brand new PC game you just bought but hadn't opened? Does the EULA go to the cat? Does it still pertain to you, even if you never agreed?"

Ok so while the notion is absurd, the idea does bring up interesting points. What if you had a game that you let a child open, even for legitimate reasons. The child can't be entered into a contract, which is what a EULA breaks down to, cause he/she is under 18. The pet senario is less likely, but possible. The whole "the instant you open it" type situation is a slippery slope.
