You’re not gonna like their answer to that.
It doesn't say "people who belong to the sex who creates", not "people who create".
It was clearly an attempt to avoid the issue with XXX, XXY, XYY, etc chromosomed people, but this semi-scientific way of attempting to describe it doesn't actually work any better.
Setting aside that, at conception, you're not a person but literally one cell, by definition (and claiming that as the point of personhood opens a billion other cans of worms), there's no way to determine what sex a zygote or gamete belongs to at conception...other than chromosomal checks.
How is this supposed to be enforced? How is this supposed to be proven?
How is this even intended to work?
Oh, right, it isn't, it's just a way to criminalize anybody not to their liking and make discrimination easier.
It just says the "sex that produces" the ova, not that it has to be able to produce viable ova (else post-menopausal women would not be women). Since we are all female at conception and would produce ova eventually without intervention, we are now classified by the government as female.
But we're not, at conception we're just undifferentiated cells that just split/clone themselves.
And looking it up, that happens for 3 whole weeks before any "sex" stuff (well, any stuff, to be more precise, since the cells before that are basically super step cells that ca turn into any part of you) gets switched on/off:

That being said, i guess "we're all classified as female now" does work to show how dumb it is because any attempt to disprove it by going deeper into it just shows even more why it's stupid.
