Wow, this is a completely different story than one I read a few weeks ago. That one was about a "lemonade stand" that got shut down, but it was adults running it, charging for bottled water and sodas to people who were parking on the street for some nearby event. If this really was just little girls trying to save for a waterpark, that's just sad.

The law was probably written to stop fly by night taco trucks, and warm water hot dog carts. You can't enforce such a law to clean up the town, without being fair about it.

Unfortunately @lien, that's exactly what you have to do... otherwise, we get called on the carpet for "profiling" or "picking and choosing," something that gets cases thrown out of court with a quickness. Showing impartiality for the subject, while douchetacular, means that the officer is being even-handed. At least the girls were not given a citation...

There should be an exemption for youth selling under $50/day on their own property though.

If they go try to sell it at the park, or they make a big operation out of it and clear $300/day, or it's a 30 year old person, then go ahead and demand they comply with health and sales regulations.

But it should be stupid easy to set up an examption that would allow kids to make a little pocket change on their own property.

i mean it said the police basically said take it down, so they did, being kids that should be all that is required if both sides are being polite. I mean a citation would be kind of heavy handed for minors running what was probably a few days of lemonade and not being smartasses. I would not expect anyone least of all children to know such laws exist on the books.

So what if adults do the selling for an event? People do that all the time for neighborhood yard sales. You buy soda and water in bulk and make like 25 cent a bottle profit.

So you believe the police should interpret the laws and enforce them according to their interpretation?

Seems like it would lead to a great deal of inconsistency and corruption.

Regardless, that's not how our system of government works. The executive branch makes sure the laws are followed. The judicial branch interprets the laws and applies them to individual cases. The legislative branch makes the laws.

The police likely fall under executive, so as much as they might like to act as judges, they really don't have the authority to do so.

Either you are suggesting that people change the law, or you are suggesting a fundamental change in the way our government operates. The police aren't allowed to "look the other way."

If a legislator writes a stupid law, they get to enforce it, or risk losing their jobs and worse.

As it happens, one of my buddies is an officer with Midway... I talked to him after I posted above. He said that he didn't know why his chief lost their mind... he, himself had just bought some of the lemonade in question the day before they got shut down. *eyeroll*

I don't really have a opinion about this story. I just wanted to say I never understood the appeal of lemonade stands. I had one once as a kid and lost interest in about five minutes.

you know, if it was an adult lemonade stand or run by an adult then I can understand. Lemonade stand are usually kids trying to "make some money" via selling simple kool aid or country time lemonade mix. I always support these kids (even if I don't drink them) they are like 50cent to a dollar.

Also this was sold in front of their parent's home not at the super market (remember the girl scout incident in the same state selling cookies)

Police use their judgement all the time. Hell go lookup what the speed limit is during adverse weather. Hint, it's whatever the officer on duty feels it should be, and the adverse weather is too.

Yeah, i wasn't exactly talking about the footmen of the police force, obviously they have to do what they're told... although i do at least expect them to ask some questions about it...
