One of the thing I do is buy warranty replace with Best buy or Micro Center with high price items.Yeah, it sucks. I advise you don't buy from manufacturers that don't have a warranty replacement policy that doesn't meet your strict requirements.
Of course they can't make a promise to you now because not only is the recall new and the situation will change over the next few weeks, but the items they have to send out as replacements now might not be around when your unit is put in the queue. The stock situation will change rapidly, so even if they wanted to they can't predict now what you'll receive, nevermind guarantee that you'll get your first choice.
You pushed them about as far as they'll go, and you got at least a little valuable information - you won't get the latest new-gen model.
It sucks. I've never been terribly happy with warranty replacements. I even marked my camcorder when I had to send it in to Canon to make sure I got the same one back repaired rather than a refurbished one. It's one of the things that helps me avoid being an early adopter (although not always successfully). Getting an electronic device when it's first released is fun, but getting one 3-6 months after release is safer. Wouldn't have helped in your situation, of course.
And, of course, you don't have to obey the recall. Replace the battery yourself, or find a shop to do it for you. It'll cost you money you wouldn't have to pay under the recall, but if it's made you this angry, it's probably worth considering.

I did it with one of the early version of MP3 player (around 100 at the time for like 16MB I think) anyways, it died, I bought the warranty and they gave me a new one. It died again, and I got upgraded version cause the current version was no longer being sold.
I did it with a TV (500$ at a the time) it had some issue and call it in. They send a tech over and repair it free of charge (which was nice) I got a replacement warranty for my Xbox 360 and replace it in store (via Micro Center) 6 times. granted each one was a refurb, but instant exchange until I got fed up, return and got a PS3. (happen within 6 month)

I've had to have a camcorder repaired a few years ago, then my iPhone 3GS was replaced after a few months when it stopped being 3G (and would only work on edge). Other than that things just work. On the other hand, I may not buy as much new electronics as others.
Sounds like they've got a pile of refurbished older gens, and you'll get one of them. Support's got no clue what kind you'll get.
It's a windows phone, so it didn't google. It binged.Just saw the comparison video. Siri is clearly 80x superior (Apple hater here, so no bias [ironic?]). But I wonder if it would have been different if it was an American speaking. Even I was like, "The hell did he just say?"
Granted, Siri talked back, whereas Windows phone just googled, or, something.

In my case, it was a case of sending out the request on November 15th, and not getting the damn box to send my nano back till Dec 20th. Oh well replacement gen 6, can't beat that.
