I think that it was The Hollywood Reporter where I read that if NBC was so sure it was on the right to move The Tonight Show to 12:05 and be in compliance with Conan's contract they would have sued him for breach of contract long ago. They're not convinced that if this went to court a "we don't specify the time slot" loophole would really work against a "the time slot for the Tonight Show has not changed in 60 years" defense.
Apparently this means that although Leno will get the Tonight Show back, they'll avoid further confrontation by releasing Conan to appear on another network even before his contract expires.
